Download NIPER (Amendment) Act 2021, link given below: The Ministry of Chemicals and Fertilizers has issued a notification bringing the provisions of the National Institute of Pharmaceutical Education and Research (Amendment) Act, 2021, into force on May 25, 2022.

The amendment Act has declared six additional National Institutes of Pharmaceutical Education and Research (NIPERs) as institutions of national importance, as against the one institute in the original Act.

The Ministry has also notified the Council (National Institute of Pharmaceutical Education and Research) Rules, 2022 with provisions set for functioning of the Council, manner of filling vacancies in the Council, and others mandating that the Council should meet at least once in every six months.

The Amendment Act, which was introduced in the Lok Sabha on March 15, 2021, to amend the National Institute of Pharmaceutical Education and Research Act, 1998, which declared the NIPER established in Punjab, as an institution of national importance, was passed by the Parliament in December, last year.

The amendment gives powers to these autonomous institutes to hold examinations, grant degrees, diplomas and other academic distinctions or titles and receive funding from the Central Government.

The six NIPERs which will have the powers of Institution of National Importance, with the new Bill, include the institutes in Ahmedabad, Hajipur, Hyderabad, Kolkata, Guwahati and Raebareli.

The Council is set up under the chairmanship of the Minister in charge of the DoP.

It would coordinate the activities of all NIPERs and advise them on issues relating to:

  • Duration of the courses,
  • Lay down policy,
  • Examine development plans,
  • Examine the annual budget estimates of each Institute,
  • Recommend the Central Government regarding allocation of funds and advise the Visitor in respect of any function to be performed by him under this Act.

The composition, powers etc. of the Council are similar to those prescribed for IIT Council as per IIT Act.

As per the functions assigned to the Council, it shall exercise its functions either directly or delegate such of its functions as considered necessary to Chairperson of the Council.

The Council may set up such Committee or Committees, standing or ad hoc, with definite terms of reference, as are considered necessary. The report or reports of such Committee or Committees shall be placed or consideration and decisions of the Council at its meeting.

The Act, in 1998 was earlier amended in 2007 to provide powers to the Central government to establish similar institutes in other parts of the country, following which the six NIPERs were announced.

The government is also working on various policies to support research and development activities in the institutes and provisions to help faculty and students to bring the innovations to commercialisation.

A Parliamentary Panel, headed by Member of Parliament Kanimozhi Karunanidhi, in their report on August 4, 2021, recommended the government to take steps to set up own campuses for all the NIPERs and chalk out concrete proposals for the timely setting up of the five additional NIPERs the government announced in 2012.

The Department also has to take steps to increase the annual intake in the institutes.

The Committee recommended that the Department should pursue vigorously at the highest level with the Ministry of Finance for the early EFC approval along with the appropriate financial outlay for the construction of own campuses for all these NIPERs in a time bound manner.

The proposal to set up five more NIPERs at Madurai (Tamil Nadu), Jhalawar (Rajasthan), Nagpur (Maharashtra), New Raipur (Chattisgarh) and Bengaluru (Karnataka) is also in progress.
