Download notifications, links are given below: With an aim to crack down on cannabinoid and sedative abuse, the central government has notified opioid analgesic isotonitazene as a narcotic drug and seven other cannabinoids and sedatives as psychotropic substances under the Narcotic Drugs and Psychotropic Substances Act (NDPS Act), 1985.
According to a notification issued by the Department of Revenue on September 22, 2022, isotonitazene, its salts, and preparations thereof have been classified as a manufactured drug (narcotic), with immediate effect.
The circular notified a total of eight substances, their salts, and preparations as psychotropic substances, with immediate effect.
These include:
- Opioid analgesic isotonitazene
- Synthetic cannabinoids– cumyl-pegaclone,
- MDMB-4en-Pinaca,
- Psychoactive substance– 3-methoxyphencyclidine,
- Dissociative anesthesia– diphenidine,
- Benzodiazepine– clonazolam,
- Anti-anxiety drug– diclazepam
- Sedative– flubromazolam.
After the reclassification, these drugs will no longer be available over the counter or in a hospital.
In a bid to address and counter the world drug problem, last year the UN Commission on Narcotic Drugs decided to include isotonitazene under the Single Convention on Narcotic Drugs of 1961.
The Commission also decided to include cumyl-pegaclone, MDMB-4en-Pinaca, 3-methoxyphencyclidine, and diphenidine in Schedule II of the Convention on Psychotropic Substance of 1971.
The Commission further decided to include clonazolam, diazepam, and flubromazolam in Schedule IV of the 1971 Convention.
India is a signatory to the UN Single Convention on Narcotic Drugs (1961), The Convention on Psychotropic Substances (1971), and The Convention on Illicit Traffic in Narcotic Drugs and Psychotropic Substances (1988), which prescribe various forms of control aimed at achieving the dual objective of limiting the use of narcotic drugs and psychotropic substances for medical and scientific purposes as well as preventing the abuse of the same.
Hence the government has brought these substances under the NDPS Act.
Following the reclassification of eight cannabinoids and sedatives under the NDPS Act, the Indian Drug Manufacturers’ Association (IDMA), representing the industry on prominent issues such as pricing, regulatory affairs, and other policy matters, has directed its member companies to ensure compliance as provisions in the NDPS Act grant law enforcement agencies extensive powers to clamp down on malpractices related to drug abuse.
