The Directorate General of Trade Remedies (DGTR), the investigation arm of the Union Commerce Ministry, has launched an investigation into the alleged dumping of sodium cyanide (NaCN) imported from China, the European Union (EU), Japan, and Korea.
This move comes after an application was filed by Hindusthan Chemical Company and United Phosphorus Limited, who have alleged that domestic industries are suffering from material injury due to the dumped imports of sodium cyanide.
Sodium cyanide is widely used in the manufacturing of bulk drugs, insecticides, dyes, and pigments.
In accordance with the Customs Tariff Act, 1975 and the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the applicants have requested the imposition of anti-dumping duties on these imports.
DGTR director general Anant Swarup has stated that a comparison of the normal value and export price at the ex-factory level establishes prima facie evidence that the dumping margin is above the specified level and is significant in respect of the product under consideration from these countries.
DGTR will consider imports of the product between April 2019 and March 2022 for the purpose of the investigation.
If it is found that the dumping has caused material injury to domestic players, DGTR would recommend the imposition of anti-dumping duty on these imports.
The final decision to impose duties lies with the finance ministry.
Anti-dumping probes are conducted to determine whether domestic industries have been harmed by a surge in cheap imports, and the imposition of anti-dumping duties under the multilateral regime of the World Trade Organization (WTO) aims to ensure fair trading practices and create a level-playing field for domestic producers.
