FDA fixes upper limit for Wholesalers & Retailers for storage, sale of NDPS

The misuse of these drugs has affected the health of children.

In a bid to curb the abuse of narcotic drugs and psychotropic substances as intoxicants in the state, the Food Safety and Drug Administration (FSDA) Department, Uttar Pradesh has fixed the maximum limit for storage and sale of these substances for drug traders.

Codeine

As per a circular issued by UP FSDA on August 15, 2022, company depo and carrying and forwarding (C&F) agents can sell codeine-based cough syrup (100 ml) up to 500 bottles to a drug wholesaler daily.

There is no upper limit for them to store the 100 ml syrup. Drug wholesalers are allowed to store up to 1,000 bottles of 100 ml syrup and can sell 100 bottles to a retailer per day while retailers are permitted to keep stock of 100 bottles of 100 ml syrup and sell only one bottle against a bill per day, stated the order.

It further said that there is no limit for company depo and C&F agents to store codeine-based cough syrup (50 ml) but they cannot sell more than 500 bottles of 50 ml syrup to a wholesaler per day.

Wholesalers are allowed to keep stock of 1,000 bottles of 50 ml syrup and sell 100 bottles of the syrup to a retailer per day while retailers are permitted to store 100 bottles of 50 ml syrup and sell only one bottle against a bill daily.

Besides this, there is no limit for company depo and C&F agents to keep stock of any other pack size of codeine-based cough syrup but they cannot sell more than 500 bottles to a wholesaler daily.

Wholesalers and retailers are allowed to keep stock of 1,000 and 100 bottles respectively. For wholesalers, the daily sale limit against one bill is fixed at 100 bottles and retailers are allowed to sell only one bottle against a bill daily.

Tramadol

For tramadol (all strengths and combinations), wholesalers can store up to 10,000 tablets/capsules/ampules while retailers can store up to 2,000 tablets/capsules/ampules.

On one bill issued by a wholesaler, a maximum of 200 tablets/capsules/ampules can be sold, and retailers can sell them as per doctors’ prescription.

Alprazolam

Similarly, wholesalers can store up to a maximum of 10,000 tablets/capsules/ampules of alprazolam and sell a maximum of 200 tablets/capsules/ampules against one bill, while retailers can store up to a maximum of 1000 tablets/capsules/ampules and sell a maximum of 20 against one bill.

Clonazepam

For clonazepam (all strengths and combinations), wholesalers can store up to a maximum of 10,000 tablets/capsules/ampules and sell a maximum of 200 tablets/capsules/ampules against one bill, while retailers can store up to a maximum of 2,000 tablets/capsules/ampules and sell a maximum of 20 against one bill.

Diazepam

For diazepam (all strengths and combinations), wholesalers can store up to a maximum of 2,000 tablets/capsules/ampules and sell a maximum of 50 tablets/capsules/ampules against one bill, while retailers can store up to a maximum of 200 tablets/capsules/ampules and sell a maximum of 10 against one bill.

Nitrazepam

For nitrazepam, wholesalers can store up to a maximum of 2,000 tablets/capsules/ampules and sell a maximum of 50 tablets/capsules/ampules against one bill while retailers can store up to a maximum of 200 tablets/capsules/ampules and sell a maximum of 10 against one bill.

Pentazocine

For pentazocine, wholesalers can store up to a maximum of 2,000 tablets/capsules/ampules and sell a maximum of 50 tablets/capsules/ampules against one bill while retailers can store up to a maximum of 50 tablets/capsules/ampules and sell a maximum of 10 against one bill.

Buprenorphine

For buprenorphine, wholesalers can store up to a maximum of 2,000 tablets/capsules/ampules and sell a maximum of 50 tablets/capsules/ampules against one bill, while retailers can store up to a maximum of 50 tablets/capsules/ampules and sell a maximum of 10 against one bill.

The order will not be applicable to government hospitals, cancer hospitals, and mental health facilities.

However, the order permits drug wholesalers and retailers to keep stock of these drugs beyond the prescribed limit after submitting purchase-sale documents for the last couple of years along with a suitable reason for it.

AK Jain, Drug Controller, Uttar Pradesh said “Action will be taken against those who flout the prescribed limit. Narcotic drugs and psychotropic substances are used for medicinal purposes but certain people and firms have misused them as intoxicants to gain monetary benefits.”

The misuse of these drugs has affected the health of children.

It is learned that several drug traders keep stock of narcotic drugs and psychotropic substances beyond their requirement and sell these drugs illegally while the number of real users of these drugs is very few.

Hence we have decided to fix the maximum limit for storage of these drugs in the interest of public health.”
