Brainstorming session of Drug Regulators on Cosmetic Rules 2020

A webinar “Brainstorming session” organised by Food and Drugs Administration (FDA) Madhya Pradesh chaired by Dr Sanjay Goyal, IAS, Commissioner Food Safety and Shobhit Dy Drugs Controller cum Controller Drugs Madhya Pradesh moderated this session.

Narender Ahooja, State Drugs Controller (SDC), Food and Drugs Administration (FDA) Haryana, PK Jaggi Retd former ASDC, FDA Delhi and RK Chugh former ASDC, FDA Haryana were main speakers and panelists of this brain storming technical session on Cosmetic Rules 2020 which are notified on 15 December 2020.

Brainstorming session on Cosmetic Rules 2020

Beginning the session and making presentation Ahooja pointed out that many new definition introduced in these Cosmetic Rules 2020 e.g. 
-Actual Manufacturer
-Legal Manufacturer
-New Cosmetic

All these definition introduced in the Cosmetics Rules 2020 need more clarification.

Fee

As per Cosmetics Rules 2020, now there is no need Inspection before the Grant of Cosmetic License on COS-8. Fee has been increased from ₹3500/- to ₹10,000/- with ten items for each category free with grant of license.

Now fee for additional item is ₹500/- per item and for additional category of item again a separate fee of ₹10,000/- with ten items free for each category. 

PK Jaggi elaborated the Chapter IV onwards and pointed out that many clarification required to be sought from CDSCO for proper implementation and harmonized interpretation and implementation of these Rules.

Central Cosmetic Laboratory

RK Chugh commented on “Central Cosmetic Laboratory” and urged that this will require an amendment in Section 6 and 25(4) of Drugs Act. He also informed that for Govt Analyst for Analysis of Cosmetics a separate notification is required and now time line of 60 days fixed for Analysis of Cosmetic Samples. 

Manmohan Taneja, ASDC, FDA Haryana through light on the cosmetics being manufactured in the garb of ayurvedic medicine. He cleared that there is no provision of cosmetic in the ayurvedic.

Regulators from Madhya Pradesh, Haryana, Delhi and Punjab actively participated in this brain storming session and got many clarification.

Dr Sanjay Goyal, IAS, Commissioner FDA Madhya Pradesh while chairing this session appreciated the efforts of Regulators and also ensured to seek clarification and rectification from CDSCO where ever required in these Cosmetic Rules.

Dr Sanjay Goyal CFDA stressed to organize more such educational webinars. Shobhit DDC in the end presented the Vote of Thanks to expert panel and all participants.
