Uniform code
The Indian government has taken a significant step to curb unethical marketing practices in the medical device industry by means of implementing new uniform code.
The Department of Pharmaceuticals (DoP) implemented a uniform code that outlines specific guidelines for marketing practices in the sector.
Key Provisions of the Uniform Code
Prohibition of Foreign Workshops:
The DoP has urged medical devices associations to refrain from organizing workshops abroad for healthcare professionals.
Additionally, offering hotel stays or monetary grants to healthcare professionals is strictly prohibited.
Establishment of Ethics Committees:
All associations are required to form ethics committees for marketing practices in medical devices (ECMPMD).
These committees should have a detailed procedure for handling complaints and should be linked to the UCPMP portal of the DoP.
Transparency in Sample Distribution and Expenses:
Medical device firms are mandated to disclose particulars related to the distribution of evaluation samples and expenses incurred on conferences, workshops, and seminars.
Restrictions on Product Promotion:
A medical device cannot be promoted before receiving product approval from the regulatory authority.
Clear Communication on Safety:
The term “safe” or “safety” cannot be used without qualification, and it is prohibited to categorically state that a medical device has no adverse consequences.
Restrictions on Gifts and Hospitality:
Medical device companies and their agents are not allowed to offer gifts that benefit healthcare professionals or their families personally.
Extending travel facilities or hospitality services, such as hotel stays or expensive cuisine, to healthcare professionals or their family members is also prohibited.
Prohibition of Monetary Grants
Companies and their representatives cannot make cash payments or monetary grants to healthcare professionals or their family members.
Compliance and Reporting Requirements
Medical device companies are required to upload the Uniform Code for Marketing Practices in Medical Devices (UCMPMD) 2024 on their websites.
They should also publish a detailed procedure for lodging complaints, linking it to the UCMPMD portal of the DoP.
