Faridabad, Haryana – A decisive operation conducted by the Officers of Faridabad, Food and Drug Administration Haryana (FDA Haryana), has exposed the illegal sale of Medical Termination of Pregnancy kits (MTP kits) at a local medical store.
The raid targeted M/s Sharma Medicos, situated near the Badarpur border in Dayal Nagar, following a tip-off regarding the illegal sale of these sensitive drugs, i.e., MTP kits.
Regulatory Violations uncovered
The FDA team, comprising Drug Control Officers Sandeep Gahlain (Faridabad-II) and Parveen Rathi (Faridabad-III), has done a meticulously planned decoy operation at Sharma Medicos, Plot No. 640, Masjid Road, Faridabad.
The investigation was initiated based on secret information that the medical store was selling MTP kits without requiring a mandatory prescription from a Registered Medical Practitioner (RMP) at an approved MTP center.
It was also suggested in the information that the sale of MTP kits was being conducted without issuing any cash memos and in the absence of a registered pharmacist, a mandatory requirement of the Act.
Father of Proprietor involved in Illegal Sale
During this decoy operation, the team observed that Mohan Lal, the father of the pharmacy’s proprietor, is involved in this illegal activity.
Shockingly, it was Mohan Lal who allegedly provided the MTP kit to the decoy customer, prompting the immediate raid on the establishment.
Following the transaction, the FDA officials revealed their identities and the purpose of their visit to Mohan Lal.
MTP Kit Seized and Medical store Sealed
The FDA team thoroughly searched the licensed premises and recovered the MTP kit that was sold to the decoy directly from the counter of the medical store.
When demanded, Mohan Lal could not produce any purchase and sales records related to the seized MTP kit, indicating a clear violation of drug regulations.
Keeping in view the serious violations of the Drugs Act and considering the public health at risk, the team seized the MTP kit on Form 16 as per the procedure laid down in the Act.
Furthermore, to prevent any continuation of these illegal activities and in the broader public interest, the FDA team took decisive action by sealing the medical store under Section 22(1)(d) of the Drugs Act to stop the furtherance of the offense.
