All lndia Drugs Control Officers’ Confederation (AIDCOC) has represented to the Secretary, Maharashtra Public Service Commission to revise the education qualification advertised for the post of Assistant Commissioner, FDA of the State to be line with Rule 49-A of the Drugs and Cosmetics Rules, 1945.
The Confederation will strive to ensure that such discrepancies are not repeated in such recruitment against the provisions of the D&C Rules, 1945 and the Recruitment Rules of the State.
Ref : Advertisement No : 020 of 2022 dated 19th March 2022 published by MPSC for recruitment to the post of 15 numbers of Assistant Commissioner Drugs , Group – A, in Food & Drugs Administration Department, Maharashtra.
Content of the representation is as under:
It is our pleasure and privilege to communicate with you on behalf of the AIDCOC, representing Drugs Control Officers in lndia.
I am also happy to inform you that the Drugs Control Officers working in all the states and the Central Drugs Standard Control Organization (CDSCO) are affiliated to our organization either throu8h their State Associations or in their individual capacity.
I am writing this letter to invite your kind attention to the anomalies in the advertisement, in para 8.1 vide reference cited above (O2O/2O22 dated 19.03.2022) published inviting applications for the post of Assistant Commissioner Drugs (15 posts), Group – A, in Food & Drugs Administration Department, Maharashtra to be filled up through your organization.
The required educational qualification for the above post mentioned in the advertisement as “
Possess degree in Pharmacy or Pharmaceutical Chemistry or degree in Pharmacology with
specialization in Clinical Pharmacology or Microbiology from o recognized University established in lndia by law.
After careful scrutiny of the qualification stipulated in the advertisement for the above post, we find that educational qualification is not in conformity with Rule – 49A of the Drugs & Cosmetics Rules, 1945 and Recruitment Rules framed by Govt. of Maharashtra for the above post.
Rule-49A: ” he is o graduate in Pharmacy or Pharmaceutical Chemistry or in Medicine with specialization in Clinical Pharmacology or Microbiology from o recognized University established in lndia by Low”.

ln view of the above ,it is humbly submitted that the present advertisement issued by MPSC is not in line with the provisions of Drugs & Cosmetics Act , 1940 read with Drugs & Cosmetics Rules , 1945 and recruitment Rules framed by the Maharashtra Government.
Hence, on behalf of All lndia Drugs Control Officers Confederation (AIDCOC), we request your kindself to take suitable measure for revision of educational qualifications for the said post and necessary action to issue revised notification in consonance with Recruitment Rules & Rule- 49A of the Drugs & Cosmetics Rules,1945.
