Unveiling the Essence: The Importance of Food Naming on Packaging
In the intricate world of food packaging, the name of the food takes centre stage, acting as a gateway to understanding its true nature.
The regulations governing this aspect, as laid out under the Food Safety and Standards Act, are meticulous and crucial for consumer awareness.
Let’s dive into the specifics of naming requirements on food packaging.
1. The Significance of Food Naming
The name of the food serves as a beacon, guiding consumers to make informed choices.
It is a fundamental aspect of food labelling, indicating the true nature of the contents within the package.
This information is not just a label; it’s a promise of authenticity.
(a) Essential Composition Specifications
In cases where a food’s identity is established through essential composition, as specified under the Food Safety and Standards Regulations, the provided name must be used.
This ensures that the core components defining the food are accurately represented on the packaging.
(b) Common or Usual Name in Absence
In the absence of a specified name, the regulations allow for the use of either a common or usual name.
This provides flexibility, allowing manufacturers to use names that consumers are familiar with or that accurately describe the nature of the food. An accompanying description can also be utilized for clarity.
(c) Incorporating Coined, Fanciful, Brand, or Trade Names
Adding an element of creativity, packages may bear a “coined,” “fanciful,” “brand,” or “trade name.” However, compliance with the Food Safety & Standards (Advertising and Claims) Regulation 2018 is imperative.
This regulation ensures that such additional names do not mislead or deceive consumers.
2. Compliance with Regulations: A Necessity, Not an Option
Ensuring compliance with these regulations is not merely a legal formality; it’s a commitment to transparency and consumer trust.
Manufacturers are entrusted with the responsibility of accurately representing the essence of the food through its name on the front of the pack.
3. Striking the Balance: Creativity and Compliance
While the regulations lay down specific guidelines, they also recognize the need for creativity in branding.
The allowance of “coined,” “fanciful,” “brand,” or “trade names” adds a layer of uniqueness to the packaging, but this must not compromise the accuracy of information conveyed to the consumer.
4. The Intersection with Advertising and Claims Regulation
The use of additional names on packaging intersects with the Food Safety & Standards (Advertising and Claims) Regulation 2018.
This regulation sets the boundaries for the inclusion of creative names, ensuring that they enhance rather than mislead consumer understanding.
